This Policy is issued by Priyam Sarma, an individual sole proprietor and the Service Provider under the Website Terms and Conditions (“Terms”). This Policy forms an integral part of the Terms and must be read together with the Terms and the Privacy Policy.

1.4. This Policy does not create any refund, cancellation, rescheduling, chargeback, compensation, credit, transfer, exchange, or adjustment right except to the limited extent expressly stated in this Policy, the Terms, or any written confirmation issued by the Service Provider.

2. Defined Terms

2.1. Capitalised terms used in this Policy shall have the meanings assigned to them in the Terms unless this Policy expressly defines them separately.

2.7. “Paid Add-on” means an optional paid feature, addition, or upgrade selected through the Website or booking panel, including additional session duration, video call access, or any other paid option displayed at the time of booking.

3. Policy Acceptance

3.1. The Prospective Client or Client is deemed to have accepted this Policy by accessing the Website, using the booking system, selecting any Service, selecting any Paid Add-on, submitting personal details, completing payment, communicating with the Service Provider, or participating in any Service.

3.2. A Prospective Client or Client who does not agree with this Policy must not book, purchase, pay for, or participate in any Service through the Website.

3.3. This Policy forms part of the Terms by reference. Any Website booking for Consultation or Coaching shall remain subject to the Terms, this Policy, and the Privacy Policy.

4. Website Bookings

4.1. This Policy applies to Website bookings for Consultation and Coaching only.

4.2. The Website may display Service details, base fees, available time slots, Paid Add-ons, payment options, delivery modes, and other booking-related information through the Website, service page, booking panel, checkout page, payment page, or other relevant booking interface.

4.3. A Booking becomes a Confirmed Booking only after the payment is successfully authorised and the booking is confirmed through the Website, booking system, payment gateway, email, SMS, WhatsApp, or written confirmation from the Service Provider.

4.4. The Service Provider may rely on booking records, payment records, transaction records, communication records, platform logs, attendance records, and written confirmations to determine refund, cancellation, rescheduling, no-show, late attendance, and payment-related matters.

5. Final Checkout Amount

5.1. All Website prices and payments shall be displayed and payable in Indian Rupees (INR or ₹).

5.2. The Client must pay the final checkout amount displayed in Indian Rupees (INR or ₹) at the time of payment.

5.3. The final checkout amount may include the selected Service fee, selected Paid Add-ons, applicable taxes, payment gateway charges, platform fees, transaction charges, or any other payment-related amount clearly displayed at checkout.

5.4. The Service Provider shall not impose hidden charges for Website bookings.

5.5. The final amount displayed at checkout shall control the amount payable by the Prospective Client or Client for the relevant Booking.

6. One-Hour Cancellation

6.1. A Client may cancel a Website booking for Consultation or Coaching and request a refund only where the Client sends a clear cancellation and refund request to the Service Provider within one (1) hour from the time of successful booking/payment.

6.2. The cancellation and refund request under Clause 6.1 may be submitted through WhatsApp, SMS, or email at request@priyamsarma.com

6.3. The cancellation and refund request must clearly identify the Client, the booked Service, the booking details, and the refund request.

6.4. The one-hour cancellation window shall be calculated according to Indian Standard Time (IST) or the timestamp recorded by the Website, booking system, payment gateway, or Service Provider’s communication records.

6.5. A refund request shall be considered within the one-hour cancellation window only where the Service Provider receives the request within one (1) hour from the time of successful booking/payment.

7. Non-Refundable Bookings

7.1. After the one-hour cancellation window under Section 6 expires, the Confirmed Booking shall become non-refundable unless the Service Provider expressly approves otherwise in writing or applicable law requires otherwise.

7.2. Cancellation by the Client after the one-hour cancellation window shall not create any right to refund, credit, transfer, exchange, compensation, substitute service, rescheduling, or adjustment.

7.3. Non-attendance, change of mind, personal inconvenience, scheduling conflict, failure to attend on the scheduled date and time, or failure to use the Confirmed Booking shall not create any refund right after the one-hour cancellation window expires.

7.4. The Client shall not claim any refund, credit, transfer, exchange, compensation, substitute service, or adjustment merely because the Client no longer wishes to attend or participate in the Confirmed Booking.

8. Paid Add-ons

8.1. Paid Add-ons, including additional session duration and video call access, are non-refundable once the Booking is confirmed, unless the Service Provider expressly approves otherwise in writing or applicable law requires otherwise.

8.2. A Paid Add-on applies only to the specific Booking for which the Client selected and completed payment for that Paid Add-on.

8.3. The Client shall not transfer, split, carry forward, exchange, resell, adjust, or apply any Paid Add-on to any other booking, Service, person, date, time, or transaction unless the Service Provider expressly agrees in writing.

8.4. The Client shall not receive any refund, credit, compensation, substitute service, or adjustment for unused Paid Add-ons where the Client cancels late, does not attend, joins late, fails to use the selected add-on, or fails to use the full additional session duration.

9. Rescheduling Requests

9.1. The Client may request one-time rescheduling of a Confirmed Booking by submitting a written rescheduling request by email to request@priyamsarma.com at least twelve (12) hours before the scheduled session time.

9.2. A rescheduling request may relate to the scheduled date, scheduled time, or both.

9.3. The Service Provider may approve a rescheduling request only subject to the Service Provider’s availability, open appointment slots, operational convenience, and scheduling capacity.

9.4. Rescheduling is not an automatic right of the Client.

9.5. The Service Provider may approve, reject, delay, or decline any rescheduling request at the Service Provider’s reasonable discretion.

9.6. A Confirmed Booking may be rescheduled only once, unless the Service Provider expressly agrees otherwise in writing.

10. Late Rescheduling

10.1. The Service Provider shall have no obligation to accept any rescheduling request submitted less than twelve (12) hours before the scheduled session time.

10.2. A late rescheduling request may be rejected without any refund, credit, compensation, automatic rescheduling, substitute service, or adjustment.

10.3. The Client shall not be entitled to any refund, credit, compensation, extension, substitute service, or automatic rescheduling where:

(a) the rescheduling request is submitted late;

(b) the rescheduling request is incomplete, unclear, or not properly submitted;

(c) the Service Provider is unavailable;

(d) no suitable appointment slot is available;

(e) operational circumstances prevent rescheduling;

(f) the Client has already used the one-time rescheduling option.

10.4. A rejected, delayed, incomplete, unclear, or late rescheduling request shall not affect the non-refundable nature of the Confirmed Booking after the one-hour cancellation window has expired.

11. No-Show Rules

11.1. The Client must attend the Confirmed Booking on time, remain reachable through the agreed Communication Channel, and respond to reasonable session-related communication from the Service Provider before and during the scheduled session.

11.2. The Client shall be treated as a no-show where the Client:

(a) provides incorrect, incomplete, inactive, or unreachable contact details;

(b) remains unreachable at or around the scheduled session time;

(c) fails to respond to reasonable session-related communication from the Service Provider;

(d) fails to join the scheduled session through the agreed Communication Channel or platform;

(e) otherwise fails to attend the Confirmed Booking.

11.3. A no-show shall not entitle the Client to any refund, credit, compensation, session extension, substitute service, or automatic rescheduling.

11.4. A no-show shall not revive the one-hour cancellation window under Section 6 or create any separate refund right after the Confirmed Booking has become non-refundable.

12. Late Attendance

12.1. Late attendance by the Client shall not extend the confirmed session duration or require the Service Provider to provide additional session time.

12.2. The Service Provider may end the session at the originally scheduled end time, or at any other time reasonably determined by the Service Provider, even where the Client joins the session late or loses session time due to late attendance.

12.3. The Service Provider shall not be responsible for any loss of session time caused by the Client’s late attendance, incorrect or incomplete contact details, non-response, device issues, internet issues, phone network issues, platform access issues, technical difficulties, or unavailability.

12.4. Late attendance shall not entitle the Client to any refund, credit, compensation, additional session time, substitute service, or automatic rescheduling.

13. Payment Failures

13.1. The Service Provider uses Razorpay, or any other payment gateway approved by the Service Provider from time to time, for processing Website payments.

13.2. The Service Provider does not own, operate, or control Razorpay’s payment infrastructure, payment interface, banking network, UPI system, card network, payment authorisation process, payment settlement process, or availability of any third-party payment method.

13.3. Where the Client’s account is debited but the Booking is not confirmed, the Client must contact the relevant bank, payment method provider, and Razorpay or the applicable payment gateway in accordance with their respective policies.

13.4. The Service Provider may provide reasonable support where relevant transaction records are available, but the Service Provider shall not be liable for third-party payment delays, duplicate debit issues, reversal issues, failed confirmations, settlement issues, or payment failures.

13.5. A payment attempt, payment screenshot, debit message, bank alert, or pending transaction shall not by itself create a Confirmed Booking unless the Booking is confirmed through the Website, booking system, payment gateway, email, SMS, WhatsApp, or written confirmation from the Service Provider.

14. Refund Approval

14.1. Refund eligibility shall be determined according to this Policy, the Terms, applicable law, and the records available to the Service Provider.

14.2. The Service Provider may rely on booking records, payment records, transaction records, communication records, platform logs, attendance records, and written confirmations to determine refund eligibility.

14.3. Approved refunds, if any, may exclude payment gateway charges, bank charges, platform fees, transaction charges, and taxes unless the Service Provider expressly confirms otherwise in writing or applicable law requires otherwise.

14.4. Approved refunds, if any, shall be processed to the original payment method used by the Client unless the Service Provider expressly approves another lawful method.

14.5. Approved refunds, if any, shall be processed within the timeline followed by the payment gateway, bank, payment method provider, or other relevant third-party payment system.

14.6. The Service Provider does not guarantee a fixed refund processing timeline where delay is caused by the payment gateway, bank, payment method provider, or any third-party payment system.

15. Non-Refundable Charges

15.1. Payment gateway charges, bank charges, platform fees, transaction charges, and taxes are non-refundable unless the Service Provider expressly confirms otherwise in writing or applicable law requires otherwise.

15.2. The Client acknowledges that third-party charges may be deducted, retained, delayed, reversed, adjusted, or processed according to the policies of the relevant payment gateway, bank, card network, UPI provider, payment method provider, or platform.

15.3. The Service Provider shall not be liable for any deduction, delay, reversal issue, settlement issue, processing issue, or refund shortfall caused by any third-party payment system, bank, payment method provider, or applicable tax treatment.

16. Provider Unavailability

16.1. Where the Service Provider cancels, becomes unavailable, or cannot provide the scheduled Service due to illness, emergency, technical issue, force majeure event, operational issue, platform issue, safety concern, or any unavoidable circumstance, the Service Provider may offer rescheduling or another reasonable arrangement where feasible.

16.2. Refund shall not be automatic in the circumstances described under Clause 16.1 unless the Service Provider expressly approves it in writing or applicable law requires otherwise.

16.3. The Service Provider may reschedule, modify, delay, suspend, or cancel any Booking or Service where availability, safety, delivery, communication, payment processing, platform access, technical feasibility, or operational feasibility is affected.

16.4. The Client shall not claim any automatic refund, compensation, damages, credit, substitute service, or other adjustment due to Service Provider unavailability where the Service Provider offers rescheduling or another reasonable arrangement where feasible. If the Service Provider is unable to provide the Service and no reasonable rescheduling or alternative arrangement is feasible, the Service Provider may approve a refund or other lawful resolution in writing, subject to this Policy and applicable law.

17. Misconduct Consequences

17.1. The Client shall not be entitled to any refund, credit, compensation, rescheduling, substitute service, or continued access where any Booking, communication, session, or Service is refused, suspended, discontinued, or terminated due to Client misconduct.

17.2. Misconduct may include false information, recording breach, confidentiality breach, intellectual property misuse, unlawful request, harassment, manipulation, threats, inappropriate conduct, repeated boundary violation, non-cooperation, privacy violation, defamation, or any conduct inconsistent with the Terms.

17.3. The Service Provider may rely on communication records, session records, attendance records, platform logs, written confirmations, screenshots, recordings, and other available records to determine whether misconduct occurred.

17.4. Any refund, rescheduling, or adjustment request connected with misconduct shall be subject to this Policy, the Terms, and the Service Provider’s written decision.

18. Minor Issues

18.1. The Client shall not be entitled to any refund, credit, compensation, rescheduling, substitute service, or continued access where any Booking, communication, session, or Service is refused, suspended, cancelled, discontinued, or terminated due to:

(a) false age information;

(b) lack of valid parental or lawful guardian consent;

(c) unauthorised minor participation;

(d) age-related misrepresentation;

(e) inability to verify parental or lawful guardian authority;

(f) any breach of the minor participation rules stated in the Terms.

18.2. The Service Provider may refuse or terminate any Booking, communication, session, or Service where the Service Provider reasonably considers the Service unsuitable for the minor or does not receive adequate parental or lawful guardian consent.

18.3. Any refund or rescheduling request involving a minor-related issue shall be determined according to this Policy, the Terms, applicable law, and the records available to the Service Provider.

19. Outcome-Based Refunds

19.1. The Client shall not be entitled to any refund, credit, compensation, rescheduling, substitute service, or adjustment due to dissatisfaction, lack of expected result, no transformation, no clarity, personal circumstances, change of mind, difference between expectation and experience, or non-achievement of any desired outcome.

19.2. The Service Provider does not guarantee any specific result, transformation, clarity, solution, improvement, recovery, progress, success, emotional outcome, financial outcome, relationship outcome, career outcome, spiritual outcome, personal outcome, life outcome, or satisfaction from any Service.

19.3. Outcomes depend on the Client’s personal circumstances, understanding, choices, actions, discipline, consistency, interpretation, implementation, external conditions, and other factors beyond the Service Provider’s control.

19.4. The Client remains solely responsible for all decisions, actions, omissions, interpretations, implementations, consequences, and results arising before, during, or after any Service.

20. Chargebacks

20.1. The Client shall not initiate any wrongful, false, misleading, or bad-faith chargeback for a valid Confirmed Booking.

20.2. A chargeback, payment dispute, reversal claim, or bank complaint shall not automatically create any refund right where the Booking was validly confirmed and this Policy does not permit refund.

20.3. The Service Provider may rely on booking records, payment records, transaction records, communication records, attendance records, platform logs, written confirmations, and other available records to dispute any chargeback, payment dispute, or reversal claim.

20.4. The Service Provider reserves the right to refuse future bookings, suspend communication, decline Services, or take appropriate legal action where the Client initiates a false, wrongful, misleading, abusive, or bad-faith chargeback.

20.5. The Client shall remain responsible for any chargeback fee, bank fee, platform fee, administrative cost, legal cost, or other loss caused to the Service Provider by any wrongful, false, misleading, or bad-faith chargeback, to the maximum extent permitted by applicable law.

21. Record-Based Decisions

21.1. The Service Provider may rely on available booking records, payment records, transaction records, communication records, attendance records, platform logs, written confirmations, timestamps, screenshots, recordings, and other relevant records to determine any refund, cancellation, rescheduling, no-show, late attendance, payment failure, chargeback, or dispute-related matter.

21.2. The Client acknowledges that the Website, booking system, payment gateway, bank, Communication Channels, Third-Party Platforms, and Service Provider’s records may record different timestamps due to technical, platform, processing, or system-related reasons.

21.3. The Service Provider may determine refund eligibility, cancellation validity, rescheduling eligibility, and one-hour cancellation-window compliance based on Indian Standard Time (IST), Website records, booking system records, payment gateway records, or Service Provider communication records.

21.4. The Client must provide accurate booking details, payment details, contact details, transaction references, and supporting information when raising any refund, cancellation, payment, or rescheduling issue.

22. Policy Updates

22.1. The Service Provider may update, revise, modify, replace, or amend this Policy at any time for legal, operational, technical, compliance, payment-related, policy-related, business, or Service-related reasons.

22.2. Updated versions of this Policy shall become effective when published on the Website or otherwise made available through reasonable electronic means, unless a later effective date is expressly stated.

22.3. The Prospective Client or Client remains responsible for reviewing the current version of this Policy before accessing the Website, using the booking system, booking any Service, selecting any Paid Add-on, completing payment, communicating with the Service Provider, or participating in any Service.

22.4. Continued access to the Website, use of the booking system, communication with the Service Provider, payment for any Service, or participation in any Service after the updated Policy is published or made available shall constitute acceptance of the updated Policy.

22.5. A Confirmed Booking shall generally be governed by the version of this Policy in effect at the time of booking, unless legal, operational, technical, policy, safety, compliance, platform-related, payment-related, or unavoidable circumstances require otherwise.

23. Relationship with Terms

23.1. This Policy forms part of and must be read together with the Terms and the Privacy Policy published on the Website.

23.2. The Terms shall continue to govern matters relating to Website access, Service scope, Client conduct, recording restrictions, confidentiality, intellectual property, privacy, disclaimers, limitation of liability, indemnity, force majeure, termination, dispute resolution, governing law, jurisdiction, and all matters not expressly covered by this Policy.

23.3. This Policy shall govern refund, cancellation, rescheduling, no-show, late attendance, payment failure, approved refund, chargeback, and refund-related matters connected with Website bookings for Consultation and Coaching.

23.4. In case of any direct inconsistency between this Policy and the Terms regarding refund, cancellation, or rescheduling matters for Website bookings, this Policy shall apply only to the extent of that direct inconsistency, unless the Terms, applicable law, or the Service Provider’s written confirmation provides otherwise.

23.5. No informal communication, verbal statement, courtesy message, administrative clarification, WhatsApp message, SMS, email exchange, or casual discussion shall amend, waive, override, limit, or replace this Policy unless the Service Provider expressly confirms the change in writing as a formal amendment, separate agreement, service-specific term, or binding written confirmation.
